The government’s plans to reform public sector pensions are threatening to incur a series of stoppages as serious as the general strike of 1926, according to the Unison General Secretary David Prentis. He says that the plans could affect the employment rights of up to 10 million people in forcing them to pay more in pension contributions and work longer before retiring.

What changes?

Work and Pensions Secretary, Iain Duncan Smith believes that: “If Britain is to have a stable, affordable pension system, people need to work longer, but we will reward their hard work with a decent state pension that will enable them to enjoy quality of life in their retirement.” These plans are designed to reflect the increasing level of life expectancy in the UK. To support them, the government plans to make it illegal for employers to force employees to give up work at 65 and plans to increase the age by which someone becomes eligible for state pension to 66. This reform could be implemented as soon as 2016.

What are the effects?

The detractors of these proposals insist that the government is simply penalising public sector workers. Unison President Angela Lynes says that: “The Government is determined to hit us with a triple whammy – they want us to pay more, work longer and then get less when we retire.”

The argument that the introduction of a universal system does seem to be misleading. The Telegraph reports that, in order to qualify for the full amount, worker will have to build up a National Insurance record. Those that fall below the required amount will not receive the full payment and, ultimately, this will affect those who have taken time out of work – such as women choosing to raise families and those affected by illness or disability.

The biggest losers.

Unison members working in local government have already taken industrial action in defence of their pensions and it is likely that around 1.3 million worker will be balloted for strikes later in the year. Mr Prentis warns that if there is no deal struck by the unions regarding pensions, this action will be “indefinite”. Political history has proven that reforms are generally unpopular and that initial ‘teething problems’ are often part of the process.

By choosing to behave in any of the above ways is to consciously allow a divorce to take on a life of its own, taking the focus away from those issues that are in dire need of attention: the needs of the children, the disposition of assets, the ability to survive financially post divorce, where the parties will live, with whom the children will live, how the family medical and dental expenses will be paid, and how a surviving parent and the children will be cared for should one parent die. Lives will be restructured by the divorce; there is no avoiding it. However, if people choose to meaningfully participate in the process they will retain far more control on the outcome and the future of their families.

The role of the Family Law Mediator is to channel energies positively. The less a party is able to behave in an appropriate, civil manner, the more the individual ultimately forfeits the opportunity to productively participate in bringing his or her divorce to resolution. When a participant proceeds with civility, however, the right to make life decisions is retained rather than placing it in the hands of a third party; a judge who receives select information and makes a decision based on that limited information. An attorney practicing for decades, for example, may represent multiple generations of family members who remarkably present with very similar marital problems. To add insult to injury, when a judge hears any aspect of a divorce, those hearings usually occur in a public courtroom. The veneer of privacy and dignity is non-existent in a courtroom. Mediation offers a viable alternative to all of this.

The fever pitch commonly associated with the divorce process can become so heated that individuals often waive their rights to participate effectively in the process, largely without realizing the consequences of their angry misbehavior. It is amazing that in a world that is so focused on communication via every possible medium; e-mail, texting and twittering to name a few, people in the divorce arena regularly and voluntarily relinquish the right to express themselves at all, simply because they refuse to do so in a respectful and productive manner. Workers comp cases are trickier than most others. Every commercial and industrial business that has more than three employees must have workers compensation insurance. That system is covered by the Industrial Commission. That is a state agency that makes sure everyone is playing by the rules. That means you may be entitled to your benefits from your workers compensation if you are injured on the job. It must be proven before you get to actually have the benefits. There is a process you must go through.

Generally, when an employee is injured on the job, workers compensation is the only way to fix it. That is because in rare occasions injured employees are not entitled to any other avenues of compensation. It is easy to get workers comp because whether it is the employers fault or employees fault lawyers will most times get the employee compensated. It really doesn’t matter who it is that is at fault. A worker being hurt on the job is serious whether it’s negligence from the employee or employer. Employers used to even be covered by contributory negligence which blocks liability. When the worker wins, he receives paid medical bills from the insurance company which also includes prescriptions. The insurance company can contact the medical providers you are already seeing although you may put in a request for change.

The worker will receive disability benefits from the insurance company. Disability payments are two thirds of the employees gross weekly wage. Workers comp payments are also non taxable. If it is more than a seven day period then the insurance company will start paying per day every day until the employee is back to work as long as they have a written note from their doctor saying they can’t work. The worker will not get the payment of the first seven days until 21 days have passed without going back to work. Permanent partial disability will kick in if a worker is permanently disabled. Only then is the worker entitled to lifetime benefits including medical expenses and disability payments. Workers compensation although will get you a fraction of your pay, does not work the same as other injury claims. You will not receive pain and suffering.
